Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Trioty platform, including the seller
dashboard, the buyer-facing storefronts hosted at trioty.com and its subdomains
({store}.trioty.com), and related services (together, the "Service"), operated by
Trioty ("we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
Trioty is operated by its founding team, based in Cairo, Egypt. We are in the process of formally registering a company in Egypt to operate the Service; these Terms will be updated with the registered company name and details once registration is complete.
For any question about these Terms, contact us at legal@trioty.com (or hi@trioty.com).
2. Definitions
- Seller — a business or individual who creates and operates a store on the Service to sell goods.
- Buyer — a person who places an order through a seller's store.
- Store — a seller's storefront and catalogue hosted on the Service.
- Content — text, images, product information, logos, policies, and other materials uploaded to or displayed on the Service.
- Order — a request by a buyer to purchase goods from a seller through the Service.
3. What the Service is — and what it is not
Trioty provides technology that lets sellers run an online store and manage orders that often begin as conversations on social media. We are a technology provider. We are not a party to any transaction between a buyer and a seller.
This means:
- The contract of sale for any order is between the buyer and the seller, not with Trioty.
- The seller is solely responsible for their products, prices, descriptions, stock, order fulfilment, delivery, returns, refunds, and customer service.
- Trioty does not own, sell, store, inspect, or take possession of any goods offered through the Service.
- Trioty is not a marketplace: we do not list, rank, recommend, or provide discovery of stores or products across sellers. Buyers reach a store only through a direct link shared by the seller.
We provide the tools; sellers run their businesses.
4. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract to use the Service.
- Seller accounts are created through Trioty's onboarding or invitation process. You are responsible for the accuracy of the information you provide.
- You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.
- You are responsible for ensuring that everyone you allow to access your account complies with these Terms.
5. Seller terms
If you use the Service as a seller, you additionally agree that:
5.1 Your store and products
- You will offer only goods you are legally entitled to sell, and your listings (descriptions, images, prices, availability) will be accurate and not misleading.
- You will comply with all laws that apply to your business, including consumer-protection, advertising, product-safety, labelling, and tax obligations. You are responsible for any tax arising from your sales.
- You will not sell prohibited, illegal, counterfeit, or restricted items (see Section 9).
5.2 Orders, payment, and fulfilment
- You are responsible for confirming, preparing, and delivering orders, and for honouring the store policies (shipping, refund, exchange) you publish.
- Where you use cash on delivery, deposits, or payment-proof flows, you are responsible for verifying payments and for the accuracy of the payment instructions you display to buyers.
- You are responsible for handling buyer questions, cancellations, returns, refunds, and disputes relating to your orders.
5.3 Your content
- You retain ownership of the Content you upload.
- You grant Trioty a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example resize or format images), and display your Content solely to operate and provide the Service.
- You represent that you have the rights to the Content you upload and that it does not infringe anyone else's rights.
5.4 Third-party integrations
- If you connect third-party services (for example a shipping carrier or payment provider), your use of those services is also governed by their terms, and you are responsible for the credentials and settings you provide.
6. Buyer terms
If you use the Service as a buyer, you agree that:
- Your order forms a contract with the seller, not with Trioty. Questions, changes, cancellations, returns, and refunds are handled according to that seller's published policies and directly with the seller.
- You will provide accurate contact, delivery, and payment information.
- Where a store requires a deposit or proof of payment, you are responsible for the accuracy of the information and images you submit.
- Trioty facilitates order placement, notifications, and tracking, but is not responsible for the goods, their delivery, or the seller's conduct.
7. Fees, subscriptions, and payments
- Seller subscriptions and fees. Use of certain features requires a paid plan. The fees, billing cycle, and what each plan includes are shown at sign-up or in your account, and may change (see Section 15). Unless required by law, fees already paid are non-refundable for partial periods.
- Other charges. We may charge fees such as per-order fees, transaction fees on online payments, or pass-through charges for outbound messaging or shipping, where these apply to your plan. Any such charges will be disclosed to you.
- Money flow. Where buyers pay by cash on delivery or directly to the seller's payment instructions, those funds are collected by or on behalf of the seller, not held by Trioty. Where online payment is enabled, payments are processed by a third-party payment provider and settled to the seller, subject to that provider's terms. Trioty is not a bank, payment processor, or money-services business.
- Taxes. You are responsible for any taxes applicable to your use of the Service and to your sales.
8. Shipping and delivery
Delivery is arranged by the seller, whether manually or through an integrated carrier. Delivery times, costs, and outcomes are the responsibility of the seller and the relevant carrier. Trioty is not a courier and does not guarantee delivery.
9. Acceptable use and prohibited content
You may not use the Service to:
- Offer or trade goods that are illegal, counterfeit, stolen, unsafe, or otherwise prohibited by law or by Trioty's policies.
- Engage in fraud, deception, money laundering, or any unlawful activity.
- Infringe the intellectual-property, privacy, or other rights of any person.
- Upload malware, attempt to breach or overload the Service, scrape data, reverse-engineer the platform, or circumvent security or access controls.
- Misuse buyer data, send messages without a lawful basis or required consent, or violate the terms of any integrated third-party service (including WhatsApp/Meta messaging policies).
- Impersonate others or misrepresent your identity or affiliation.
We may remove Content or restrict activity that we reasonably believe violates these Terms or applicable law.
10. Intellectual property
The Service, including its software, design, and Trioty branding, is owned by Trioty and its licensors and is protected by law. These Terms do not grant you any right to Trioty's intellectual property except the limited right to use the Service as permitted here. Trioty branding may not be used without our prior written permission. Sellers retain rights to their own Content as described in Section 5.3.
11. Third-party services
The Service integrates with third parties such as WhatsApp/Meta (messaging), shipping carriers (for example Bosta), payment providers (for example Paymob), and cloud infrastructure (for example Google Cloud and Cloudflare). Your use of those services may be subject to their own terms and privacy policies. Trioty is not responsible for third-party services, their availability, or their acts or omissions.
12. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Sellers are responsible for their own lawful handling of buyer data they receive through the Service.
13. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, Trioty disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defect will be corrected. We are not responsible for the conduct, products, or content of any seller or buyer.
14. Limitation of liability
To the fullest extent permitted by law:
- Trioty is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service.
- Trioty is not liable for disputes between buyers and sellers, for goods sold through the Service, or for the acts or omissions of sellers, buyers, or third-party providers.
- Trioty's total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid to Trioty in the three (3) months before the event giving rise to the claim, or EGP 5,000.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Indemnification
You agree to indemnify and hold Trioty harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Content, your products or transactions, your breach of these Terms, or your violation of any law or third-party right.
16. Suspension and termination
- You may stop using the Service at any time and, for sellers, cancel your subscription as described in your account.
- We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service, other users, or the public.
- On termination, your right to use the Service ends. Provisions that by their nature should survive (for example ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
17. Changes to the Service and to these Terms
We may modify or discontinue features of the Service, and we may update these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-laws rules. The courts of Cairo, Egypt will have jurisdiction over any dispute, unless applicable law requires otherwise.
19. Language
These Terms may be provided in Arabic and English. In case of any conflict or inconsistency between the two versions, the Arabic version prevails.
